Lynn v. Rite Aid (Case No.: 2:18-cv-08761)

IF YOU MADE ONE OR MORE IN-STORE PURCHASES OF RITE AID DAY LOGIC ULTIMATE SHEER CONTINUOUS SPRAY SUNSCREEN WITH AN ADVERTISED SPF OF 85 (THE “PRODUCT”) AT A CALIFORNIA RITE AID BETWEEN OCTOBER 11, 2014 and OCTOBER 30, 2019, YOU MAY BE ELIGIBLE TO RECEIVE A MONETARY PAYMENT OF $2.45.

A settlement has been reached in a class action lawsuit involving allegations that Rite Aid HDQTRS Corp. (incorrectly sued as Rite Aid Corporation) (“Rite Aid”) sold the Product with packaging that misstated the Product’s SPF. Rite Aid vigorously denies the allegations, and the court has not decided who is right. If you have made an in-store purchase of the Product from Rite Aid between October 11, 2014 and October 30, 2019 and have not received a refund or credit for all of your purchases, you may be able to receive a payment of $2.45. If you want to object to the settlement or don’t want to be legally bound by the settlement, you must object or exclude yourself by January 3, 2020, or you won’t be able to sue Rite Aid about the legal claims in the action ever again. If you exclude yourself, you cannot receive a settlement payment. The detailed notice available at the website above explains how to request exclusion or to object. The Court will hold a hearing on July 28, 2020 to consider whether to issue final approval of the Settlement. If it is approved, then to receive your settlement payment, you must file a qualifying claim. Claim Forms must be filed by October 26, 2020, or before all valid claims have been made, whichever comes first.
